Notification made voluntarily under Art. 9 para 2 SESTO-FINMA (DFC 2C_98/2013) The shares of Basilea Pharmaceutica AG ("Basilea") are held by the Funds. None of the Funds reaches or exceeds the 3% threshold. No one investor of a Fund can give instruction with respect to a specific investment or influence voting. Black Creek Investment Management Inc. is the investment manager of each of the Funds with discretionary voting authority over the shares of Basilea. Mr. Bill Kanko, 212 King Street West, Suite 500, Toronto, Ontario, Canada M5H 1K5, and Mr. Richard Jenkins, 212 King Street West, Suite 500, Toronto, Ontario, Canada M5H 1K5, as principals of Black Creek Investment Management Inc., each independently and indirectly control 36% of the voting shares of Black Creek Investment Management Inc., a privately held corporation.
